Health Guarantee

 
Your puppy has had all necessary vaccinations and worming to date.

He/she must receive his/her full set of shots, worming, heart worm and rabies shots as needed to stay healthy.

Any puppy not receiving it’s puppy shots as scheduled (6wks, 9wks, and 12wks, of age) will not be covered by this guarantee.

Your puppy is guaranteed in health against progressive retinal degeneration and hip dysplasia that would cause a painful, unhealthy life, or death…for two (2) yrs., expiring on___________ .

In the  event of such a problem, we must receive proof from “CERF” and preliminary “OFA” that there  is a genetic problem.  And, it is not the result of diet or environment.

The puppy/dog may be kept as a pet with proof of spay/neuter.  And, registration papers must be signed over to “Springer Spaniels of McCormick”.

If you and your vet decide it is in the best interest of the puppy/dog to be euthanized, “Springer Spaniels of McCormick” must be CONTACTED  prior to this action being taken.

“Springer Spaniels of McCormick” is not responsible for any bills you may incur.  Other than approved second opinion, in the event of a death, on or before of said date.

We must have a necropsy report from your vet. stating that the puppy passed as a result of a genetic default.  And, not caused by the buyer, deliberate or accidental.

In such of an event, “Springer Spaniels of McCormick” will provide buyer with a replacement puppy from a current or future litter when available.  No monies will be exchanged.

If the puppy/dog needs to be shipped back, buyer is responsible for the shipping charges.

Buyer understands that this guarantee is offered to the original buyer only.  In the case of a sale or transfer of this puppy/dog, this guarantee is null and void.

It is against this contract to sell or place this puppy/dog in a shelter or puppy mill.  “Springer Spaniels of McCormick” reserves the right to repossess any puppy/dog that is found to be neglected or abused.

Should the buyer decide to no longer keep the puppy/dog, they must first CONTACT US “Springer Spaniels of McCormick” (Ruth or Randy Montgomery-Boge) for first right of refusal or placement options.

BREEDING RIGHTS

There is no guarantee or warranty that the buyer will be able to show or breed the pet.  Breeding rights are by prior approval of “Springer Spaniels of McCormick” only.  Approval will ONLY be given for puppies that are going to be in the show ring.  All others will be sold with a spay/neuter understanding and limited AKC registration.

If full AKC registration with breeding rights is agreed upon, this dog shall never be bred to any dog other than a registered English Springer Spaniel, with prior approval from Springer Spaniels of McCormick .  Both the Dam and Sire shall have OFA certification (hips, elbows, knees) and eyes cert’d.  This includes PFK and PRA (dam or sire need to be normal certification).

REPLACEMENT

No replacement will be given if the female has been bred without prior consent of “Springer Spaniels of McCormick”.  No replacement will be given if this health  guarantee has expired.

This puppy/dog must be kept in good physical condition.  you must follow AKC recommendations for weight classifications and exercise restriction time tables.  All puppies/dogs must not be over exercised during their growth period.  Over exercising is as follows:  continual throwing an object for the dog to retrieve or jumping your dog.  All of the above mentioned will void this guarantee.

Seller is not responsible for any and all veterinarian expenses accumulated on returned or replaced puppy/dog.

In the event of any litigation in connection with this guarantee, “Springer Spaniels of McCormick”, shall be paid reasonable attorney fees by the buyer.  Venue and jurisdiction for litigation arising out of or related to this contract shall lie exclusively in Tillamook County, Oregon state.

I, the buyer (or their representative) of a puppy/dog purchased form “Springer Spaniels of McCormick”, hereby acknowledge that I have read and understand this document.  Further, I accept the terms and conditions of the guarantee for congenital or hereditary disorders printed in this document.  And, I waive and relinquish any and all other rights that might otherwise have in the event of such occurrence .  Upon signing this contract, both buyer(s) and seller certify they have read,agreed and fully understand the terms of this contract.
